UP Apartment Act — the basics

What every UP flat owner should know about the Apartment Act.


Six essentials

  • The Act — the UP Apartment (Promotion of Construction, Ownership & Maintenance) Act, 2010 governs flats, common areas and associations in Uttar Pradesh.
  • Your AOA — apartment owners form an association with registered by-laws; office bearers act under those by-laws, not personal authority.
  • Common areas — belong to all owners proportionately; a builder cannot sell or lease them away.
  • Handover — after formation, the builder must hand over common areas, accounts and corpus to the AOA (see our handover checklist).
  • Maintenance — charged per the by-laws; accounts must be maintained and auditable.
  • Disputes — Deputy Registrar (associations), GDA (building/CC issues), consumer commissions (deficiency in service) and the DM committee route in Ghaziabad.
